Vintage Wine Cellars

Terms of Use

Last updated: October 18, 2026

These terms govern the websites, online accounts, and purchases provided by Vintage Wine Cellars, LLC ("Vintage Wine Cellars," "we," "us," or "our"), including VintageWineCellars.net, VintageWineCellarsTastingRoom.com, and vwc.me. "You" means the person using our services or making a purchase.

Please read these terms before creating an account or placing an order. By taking an action that expressly indicates your acceptance of these terms, you agree to them. You may save or print them for your records.

1. Which Policies Apply

These terms establish the general agreement between you and us. The following policies govern their specific subjects and form part of the agreement when applicable to your purchase or participation:

Our Privacy Policy explains our handling of personal information. A privacy disclosure does not itself establish consent where a separate consent is required.

If a specific policy conflicts with these general terms, the specific policy controls its subject. Additional terms clearly presented and accepted for a particular purchase control that purchase. None of these documents overrides rights or obligations that applicable law does not allow the parties to change.

2. Eligibility and Lawful Purchases

You must be at least 21 years old to purchase or receive alcoholic beverages. You must provide accurate information and cooperate with age and identity verification. You may not purchase alcohol for a person under 21 or arrange unlawful receipt or resale.

We may refuse a transaction when verification fails, a legal restriction applies, we reasonably suspect fraud, or a person appears intoxicated. A website age declaration does not replace identification requirements at pickup, delivery, or an event.

3. Accounts and Security

Keep your account information accurate and your login credentials confidential. Notify us promptly of suspected unauthorized access. You may not impersonate another person or use another person's account or payment method without permission.

Some purchases and account features require registration. We may require reasonable verification before disclosing an order, changing an account, issuing a refund, or assisting with a gift card.

We may restrict or close an account for fraud, security risks, unlawful activity, abusive conduct, or material violations of these terms. We may act immediately when needed to protect our customers, employees, or systems. Account closure does not by itself cancel legitimate purchased gift-card value or amounts we owe you. We do not charge account inactivity fees.

4. Orders and Acceptance

Your order is an offer to purchase. An automated acknowledgment confirms receipt, not acceptance. We accept an order when we expressly confirm acceptance, ship or digitally issue the purchased item, or notify you that it is ready for pickup.

Before acceptance, we may reject or cancel an order because of availability, a material pricing or description error, payment failure, suspected fraud, quantity restrictions, or a legal restriction. We will notify you and refund payment collected for canceled items. After acceptance, any cancellation remains subject to applicable law and the policies governing your purchase.

You are responsible for reviewing the products, quantities, delivery details, recipient information, and total before placing an order, and for reporting errors promptly. Changes after preparation, digital delivery, or shipment may not be possible.

5. Prices, Payment, and Product Information

The checkout page displays the price, applicable taxes, and shipping or other charges before you submit an order. You authorize processing of the total you approve. Payment authorization or collection may occur during checkout. Your payment provider controls how quickly a released authorization disappears from your account.

Prices and offers may change for future purchases. We will not increase the agreed price of an accepted order or substitute a materially different product without your approval.

We make reasonable efforts to describe products accurately. Images may show representative packaging. Ratings, tasting notes, and pairing suggestions are opinions, not guarantees of personal preference. A vintage or bottle size specified in your order is part of the product description, not merely an illustrative detail.

Special orders, deposits, limited releases, private events, and recurring offerings may have additional terms disclosed before purchase. These general terms alone do not authorize a recurring charge.

6. Website Use and Intellectual Property

You may browse, make lawful purchases, share ordinary links, and save or print reasonable portions of the website for personal use. Website materials are owned by us or used with permission and remain subject to applicable intellectual-property rights.

You may not break into accounts or nonpublic systems, introduce malicious code, disrupt services, evade purchasing or access restrictions, harvest personal information without authorization, or commercially reproduce protected content without permission. Automated access must not interfere with operation, bypass controls, or misrepresent an affiliation with us.

You may not use our names or branding to suggest sponsorship or endorsement without permission. These restrictions do not prohibit lawful fair use, truthful reviews, or other legally protected activity.

7. Reviews and Other Submissions

If you submit a review, photograph, or other material for publication, you must have the right to submit it. Do not include another person's private information, unlawful content, threats, or material that infringes another person's rights.

You retain ownership of your submissions. You grant us a nonexclusive, royalty-free license to host, display, reproduce, and format them as reasonably necessary to publish them and operate the service to which you submitted them. This is not a transfer of ownership or permission to falsely attribute statements to you.

We may moderate unlawful, irrelevant, deceptive, or abusive submissions. We do not prohibit honest criticism or impose a penalty for a truthful review. Please contact us if you believe website material infringes your rights.

8. Third-Party Services

Links, ratings, embedded content, and third-party services may be subject to their providers' terms and privacy practices. We do not control independent websites or guarantee third-party opinions. Using a contractor to fulfill our obligations does not eliminate our responsibilities to you.

9. Website Disclaimers

To the extent permitted by law, the website and its general informational content are provided "as is" and "as available," without implied warranties of merchantability, fitness for a particular purpose, or noninfringement. We do not guarantee continuous availability or error-free operation.

These website disclaimers do not override an express product description, an accepted purchase commitment, or warranties and remedies that cannot lawfully be excluded.

10. Limitation of Liability

TO THE EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, INCLUDING LOST BUSINESS PROFITS, ARISING FROM THE WEBSITE OR A PURCHASE.

TO THE EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR A CLAIM CONCERNING AN ORDER WILL NOT EXCEED THE TOTAL AMOUNT PAID OR PAYABLE FOR THAT ORDER. FOR OTHER CLAIMS UNDER THESE TERMS OR ARISING FROM WEBSITE USE, OUR TOTAL LIABILITY WILL NOT EXCEED THE GREATER OF $100 OR THE AMOUNT YOU PAID US THROUGH THE WEBSITE DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

These limitations do not reduce valid purchased gift-card balances, required refunds, or amounts owed for unfulfilled orders. They do not apply to fraud, willful misconduct, gross negligence, personal injury, or any liability or remedy that applicable law does not permit us to limit. A limitation that is prohibited where it applies to your claim does not apply to that claim.

11. Responsibility for Misuse

To the extent permitted by law, you agree to reimburse us for reasonable losses and expenses arising from a third-party claim to the extent caused by your fraud, intentional unlawful use of our services, or submission of material that you knew infringed another person's rights. This obligation does not apply to our own misconduct, a legitimate product complaint, a truthful review, or your lawful exercise of consumer rights. We will notify you of a covered claim and will not agree to a settlement imposing an obligation on you without your consent.

12. Delays Beyond Our Control

Events beyond our reasonable control may delay performance. We will take reasonable steps to address a disruption and communicate material changes affecting your order. A disruption does not excuse legally required notices, cancellation options, or refunds.

13. Governing Law and Disputes

Florida law governs these terms, subject to applicable federal law and mandatory consumer protections that apply to you. Please contact us about a dispute so we have an opportunity to resolve it. Contacting us is not a prerequisite to exercising a legal right or meeting a filing deadline.

Unless applicable law gives you the right to proceed elsewhere, disputes will be brought in state courts in Hillsborough County, Florida, or the federal court with jurisdiction over that county. Either party may bring an eligible claim in a small claims court with jurisdiction. Nothing prevents a complaint to a government agency or limits nonwaivable rights.

14. Changes and General Provisions

We may revise these terms prospectively by publishing an updated version and providing any additional notice or consent process required by law. Changes do not retroactively alter an accepted order or reduce purchased gift-card value. Posting a revision does not establish consent where affirmative agreement is legally required.

If a provision is unenforceable, the remaining provisions continue to apply to the extent permitted by law. Not enforcing a provision once does not waive it. We may transfer this agreement with a sale or reorganization of the business, subject to your existing rights and applicable privacy requirements.

Provisions concerning completed transactions and continuing rights or obligations survive account closure, including outstanding payments, refunds, gift-card balances, intellectual property, applicable liability limits, and dispute resolution.
